Perrin turbo inlet CA smog legal?

I have a Perrin silicone turbo inlet. I need a smog check, and the smog guy says "Sorry, but I can't pass it with this after-market tube". He referred me to a smog referee station where he says they will look at it and if they feel it conforms to CA requirements you get a sticker which states it's OK for CA smog.

It's basically just a tube, and it connects up to all the OEM tubes and connectors.

Have others here run into this? Any ideas? Thanks!

I plan on doing just that ^^^

I did contact Perrin. They stated that their products are not CARB certified (Cali Air Resources Board, which makes the rules here). But this could be because Perrin just doesn't want to go through the regulatory hoops to get their products reviewed/approved, so they just do the "For off-road and racing use only" thing, and leave it to their customers to deal with smog problems on a case-by-case basis?

Just another FYI my father in law has a Nissan Titan with a CARB approved K&N Brand Air Intake and because the sticker was washed off, 2 smog places denied him of a smog cert and almost made him go to the referee. The second shop he even had the number printed out from the computer. This is getting bad.
