No, you do not need a tune with just a downpipe. However, let's be more specific here - we're talking about boost creep.
1) It depends on how cold it gets where you are
2) It depends on whether you get a catted or non-catted downpipe
3) It depends on the cat placement
4) It depends on whether you run the stock catback or not
5) It depends on YOUR VF39
Lots of depends eh? However, the general rule of thumb is that if you have a cat in the downpipe directly off of the turbo then you generally do not get boost creep with a full TBE. If you run the stock catback then along with that catted downpipe then you are most likely going to be good to go. TONS of people have run with a catted TBE and no engine management ... including lots of people here on this board.
A non-catted TBE gives MOST people boost creep and fuel cut. Some people haven't experienced it ... however, most just haven't wound out 5th on a really cold day (i.e. freezing outside).
I would have absolutely no reservations about installing a catted downpipe along with the stock catback. Is there a chance it will creep? Yes. It is likely? No. If you want a non-catted downpipe ... then you are starting to get risky. I would say it's a gamble ... but one worth taking if you are running the stock catback. Seems like this ends up being a 50/50 deal and depends highly on your VF39. However, that stock catback will provide enough back pressure to truly help prevent creeping.
