Default Subaru is trying to void my warranty

i took my car in a week ago because i been having that 4th and 5th gear synchro problem that seems so common.well i went to see what was going on with it today and they told me they couldnt get it to act up but it dont matter because my warranty is gonna be voided because i have an aftermarket clutch.

i told them i thought the only way they could void my warranty is if the aftermarket part was the reason my car was having problems and the parts manager told me that adding aftermarket parts automatically voids my warranty.

this baffles the hell out of me because ive had this clutch in for awhile now,nearly a year and they knew about it back in august when they had to do some warranty work on it and they didnt say anything of voiding my crap.

what should i do,need help terribly.

You need to search Mag-Moss act and bring a copy into your dealer. They are just trying to not do the work and I doubt that SOA denied the work yet. Having a lawyer write a letter quoting the Mag-Moss wouldn't hurt either...

Before you do anything, though, I'd try another dealer. You may just find that they'll do it.

Few choices...and yes they have to prove that the A.M. clutch caused the problem. Also...syncros usually go out in the low gears (i.e. 1st 2nd) due to operator error. Higher gear syncros is somewhat uncommon...I had my 5th gear changed out due to grinding and they covered it. SOA knows about the 5th gear syncro issues. So....

1.) Take it to another Subaru dealer

2.) Call SOA...and the BBB

3.) Play hardball (i.e. lawyer)

i really appreciate your help and im gonna do as instructed because i knew they were BSing me. the only problem is there are no subaru dealers other than the one in my city,the others are 3 to 5 hours away(little rock,ark and brimingham,al) so i guess im just gonna have to go to war with these screw balls.

once again,thank you very much for the info and i have a great lawyer that canhelp me out if it comes to that. first i will email SOA and if it goes any farther im bringing in the lawyer with the Magg-Moss act in hand.

just talked to a Subaru representative and she told me the same thing you guys explained(aftermarket part has to be cause of the problem before they can void my warranty). they even called my dealer before they even called me and got that stuff straight. well atleast the guy they talked to even said my warranty wasnt voided,the problem was they couldnt replicate the problem.

well ima take my car up their now and test drive it for them.

Glad SOA didn't jerk you around. Sounds like sometimes the dealers are more down on mods than SOA is.

Im no expert, but it would see to me that adding in an aftermarket (and tougher) clutch, would put more strain on the tranny during take offs and shifts. If that's the case, they certainly have merit in denying your waranty.

Am I wrong? Would that kind of extra wear on the tranny translate into damage on the syncros? or is that impossible?

well its not actually that much of a tougher clutch,and the fact that i hardly ever put any strain on my car as far as launches,hard shifting or even downshift hard and slamming the gas. im pretty easy on my car because i wanna keep this warranty. so if they try to scream abuse ill have an even better time of laughing at them.

Think about how a synchro works and its purpose. Since you shift when the clutch is disengaged, how would the clutch cause the problem? If he shifts like most people, he's already unloaded the drivetrain by getting off the throttle and clutching in. The synchros don't have any additional stress.

Now, if he had snapped a half-shaft or stripped some teeth off 1st or 2nd, then yeah, I'd say it could definitely be the clutch. Obviously this isn't the case.

No need to be a flaming smartass... Like I said, I don't really know how the innards of the tranny/gear box work. I am not a gearhead, which is why I was asking if it were ever possible.

One piece of advice I can give is if you mention the word Lawyer, the dealer is done helping you. They and SOA have lawyers that work for them Sometimes this can be a lengthy and difficult issue. Just be ready to pay and use your lawyer the moment you mention "Lawyer", because they have already retained theirs for that reason.

I would try another dealer first and if you get the same response, then try SOA. If that doesn't work, the AG office is very helpful.
