Default Previous owner had warranty denied....

So I went to the stealership yesterday to get my rear struts checked out plus an airbag light. I'm standing there and talking to the service writer and he goes "uh oh". He tells me that while he was looking up my warranty info and got a flag that the vehicle has had previous warranty claims denied due to abuse or modification!
Well I bought the car used and it had an intake on it, so I figured that was it. So he tells me that I'm going to have to pay for the diagnostics and after that we'll find out if it will be covered under warranty. Yea right, I'm not gonna get roped into paying for diags without knowing whats going on! So I had him call SOA and find out why it was denied originally. After an hour of waiting he comes in to tell me that the previous owner snapped both rear axles, and blew out both the front and rear diffs!!!!
So now I'm pi$$ed at the salesman where I bought it. I had the sales manager print out the service records before I bought the car and that page wasn't with the records. So I think the SM saw it and threw that page out. I hate stealerships!!!
So I had them take the car in to check it out. Meanwhile I made some phone calls and purposely stood right around the corner from the service desk. I was saying that if my warranty gets denied I'm gonna be on the phone with SOA and a lawyer before I even get out of the parking lot. So after all of that, about 10 minutes later the service writer comes in and tells me that everything will be covered under warranty and he was sorry it took so long. I just said thank you and scheduled an appointment for next week. But I know that I scared the crap out of him when he heard lawyer.

So to wrap everything up, this is exactly why I do my own work on my car. Stealerships will bend you over if they can!

I bought my car used and ran a car fax, but still wonder how the last guy ran it. I actually have his info and could call, but again I dont want to know if he ran it hard with 50 miles on it.

They should inform you of the diagnostic before you sign the repair order. Because they don't know what is wrong and they have to find out what is broken, and why. If what they find is covered then you aren't required to pay it.

Just because a previous claim was denied, doesn't mean anything. You can still have warranty done on the vehicle, just not that exact repair.

Also the dealers service records may not have a warranty claim denial because it isn't kept on the local dealers records. it is kept on Subaru's records for all dealers to see. Not all dealers use the same program for writing service so there has to be a way for everyone to access the claim history. That's why is is on Subarunet.com for the dealer.

Also Lawyers don't scare writers. The dealership has their own attorneys that work for them and it costs the writer nothing. when I hear the term lawyers I tell them so do we, have your attorney contact them. From my experience, you throw that word, out, you better be ready to use it. I have seen a customer or two that mentioned Lawyer and they ended up getting one because the dealers lawyer came down on them. Not what the customer had planned.

Yeah, lawyer doesn't scare anyone anymore. The dealer doesn't care, you would be going up again Subaru and I think they have a little more money and time to battle it out if they really wanted to.
