Default replacing clutch under warranty

So my clutch is fried after 14,000 miles and I'm taking it to the dealership tommorow for them to look at it. I'm cobb stage 2 with a stealthback and I am preparing to hear them deny me. My question is besides telling them that I'll contact SOA what is the name of that one case, like Morris somethingorother, the one where they have to prove it was my mods or abuse that caused it. I just want to use the correct terminology so that they no that I wont take no for an answer.

yes of course, its best to educate yourself..

but a worn clutch is a worn clutch, its wear and tear, like brakes...

If I put myself in the dealers situation, I'd deny warranty work. More power means more wear, and 14k miles out of clutch is due to how you drove it, and the increased hp and torque However, if you play it cool, they could do you a favor and work something out. If they do warranty it, consider yourself lucky, because this is a situation where I have to back up the dealer. Once you start modding, a clutch should never be covered under warranty for any reason. Good luck!!

I had a 2003 Accord v6 6-speed where the clutch fried after about 4000kms... heh

Yes a clutch is wear and tear like brakes.......however Subaru covers brakes up to 36k miles. As long as it doesn't look like abuse, it should be no problem.

Well heres my update. They denied me due to modifications as expected, but heres the kicker. They included in my modifications list things that I dont have. One of which is a blow off valve, honestly its makes me wonder if they even popped the hood. They also said that during the test drive that there were no signs of clutch slippage. Beleive me the clutch is slipping. He said that the revs did jump on him but it was so quick, he thinks its something electrical. He must have never driven an STi, the revs raise fast on STi's. To top it off, they charged me $95 dollars for driving the car and giving me bullsh!t information. Any suggestions?

I suggest wearing down that clutch a bit more, so it slips very noticably, putting car back to stock so it's undetectable, and then taking it to different dealer for warranty work. It's wear and tear warranty work under 36k miles, so if you can avoid them finding out car is modded, that is your best bet. Either that or just baby the hell out of car, so you can get more use out of clutch before having to replace. It may be slipping, but under normal driving and not as modded, it probably will hold up for quite a while. I guess I misunderstood you. You said your clutch is fried. That would mean it's slipping beyond ability to drive it very well if not much at all. Good luck!!

This is the risk you must face and own up for if you mod a car. I highly doubt the clutch would be bad if car was kept stock. You might want to just tone the car down a bit, take it easy, then when clutch gets really weak upgrade it the right way so it can meet your power mods long term. Even if you were able to get clutch replaced under warranty, history will repeat itself, unless you drastically change the way you drive. Best bet is to play by the rules, and get this car done right the second time around. You conceited that your car is modded, which means premature clutch wear, so the dealer is in the right here. I don't agree with them charging you for taking it in. That is just rubbing salt in the wound. You know the dealership is right on this, so facing up to what's been done is the right policy. Of course, you can still complain, and deny any wrong doing, but it's gonna be a painstaking process, and technicality is the only way you'll win. Sometimes the person who isn't right does win, but ask yourself if it's worth the trouble, and there's a strong possibility you will lose, because there's little denying you have caused this, and it is not the car.

Your right, its time to go aftermarket out of my own pocket. Thanx for the response. I still think the dealership is in the wrong stating I have mods that I dont and telling me its not my clutch when it is.

I am not sure, but I suspect that the Service Departments share a common database so the 2nd Dealer may know what the 1st Dealer has already done and said in their test of your car.
