Lemon law wise.
It is 18month or 18,000 miles.
If the car has been in for service total of 30 days.(for a valid warranty reason.)
Or if you brought your car in for 3 or more times.(there is more too it but this is the general idea. oh this is for cali too. not sure about the other states.)
I did some research because I have a 05 sti owned for 3 months with 3000 miles on it.
But it has been in the shop for about 40 days(and my clunking on my car has gotten worse then when I originally brought it in). They changed out rear diff twice, struts twice. endlinks center diff and noise is worse then ever.
I have to say the dealership is not flaking thought. They are trying there ass off. they just can't figure it out. I am going to give them until this coming up wed and call subaru to file a lemon.


.... I can file a lemon suit and proabably get a new car and more then likely they will not fight it. fact that it has been in there so long and being a brand new car but I am holding out because I like my 05. I prefered not to get a 06.

OH. if you do decide to have them buy back your car.
They have to pay for everything. What you original paid plus any financing fee. IF you have a attorney, they are reponsible for attorney fee as well.
If the dealership was a a-hole about the situation I would have done it long time ago but they really are trying. I even got a free gold exteneded warranty.

09/12/05 UPDATE...
OK. I Still have not gotten my car back.
45 days and counting. (getting my car is out of the question, they still don't know what the problem is.)They did find a bad center diff but that took 36 days to figure out and replace. After rear diff - rear struts(twice) - rear endlinks and a center diff.
There are more clunking then ever but binding went away.
Spoke to Reginal service rep at the dealership, I req a new car, he was kind of acting like a ass and really didn't give a **** so, I got a lawyer and now I AM GOING TO ASK THEM BUY MY CAR BACK....

But if I ever buy a another Subaru or Acura, I am going to South Coast Subaru/ACURA. The Service Manager Doug and service rep phil have been great about the situation.
