I spoke with the dealer yesterday afternoon, at that time they are still pulling the engine apart to figure out the problem.. but I was told they would replace the engine instead of repairing problem.

Since I bought the car from a dealer I have a warranty directly from them, sorry man I'm not sure how you can prove the car was maintained properly other then information provided by the previous owner.

I spoke to SOA and they said they will call the dealership to find out the root cause of the problem and go from there, are these engines prone to blow up? are the dealerships more lenient in the US?

The dealerships want maintenance records because SOC/SOA ask for that if there is an issue where there could be a possible lack of maintenance. It is no different here in the states. Granted you just bought this vehicle, but it could also have been someone else's problem and traded it. However to Subaru that car is 5 years old.

This will be tricky to work out because you are going to pay to have it repaired, but SOA may not reimburse you because the repair may not be covered. The thing is, who decides it is or isn't covered? SOC or SOA? That is what you need to be asking SOA about being you bought it in the US.

The car was not traded, I bought it from the first owner, oil starvation is an obvious problem with this engine, I checked the oil on the dip stick and it was full at the time of purchase and only drove for another 300 miles after that. So far I have found 2 oil change record.

Ok, so why did they sell it? Some people sell problems and maybe she had issues with the car and figured they could dump it. I have seen that happen a lot, not saying this is the case, but it could be.

THere are always bad apples in the bunch, but when stock, '05's followed by the '06s are the most reliable years. '04s had tuning/det. issues, '07+ had tuning/ringland issues. But any motor will be crap when it's not maintained.
