I guess i don't understand why he is upset... The dealer did a goodwill repair/overhaul/replacement of his trans and clutch at 2800 miles. If it breaks again there may be some driving error on his side. My store just replaced a clutch in a new car with 2,100 miles under goodwill and then with less than 1,000 on the repair the clutch was blown again. The manufacturer split the repairs 50/50 and then said no more as obviously this was driver error.

Everyone knows we don't have problems with our trannys/clutch so if there's another problem, it could be attrubuted to driver abuse.

Maybe if it happened again... maybe. One failure doesn't mean the owner was abusing it. **** happens and bad product makes it out the door. Who is to say that is not the case here.

But, to the OP, be very professional, respectful and calm. If you do, you greatly increase the possibility of things going your way.

Ask nandanrp what I mean

Definitely try working with SOA first before getting a lawyer involved. Only if SOA denies your claim should you get a lawyer. Lawyering up is pulling out the big guns and should only be done when other routes of persuasion have failed.

As for SOA having lawyers on retainer, that is true. But if the lawyers are any good they will be able to weigh the costs of defending a claim vs the cost of honoring the warranty claim. Getting a lawyer involved is a very good way to get what you want, but its neither the fastest nor least expensive way. That is why I suggested contacting SOA first.

Bad parts happen all the time. It's very possible (althrough not likely) that he may have gotten another borked tranny as replacement.

I have done the same on a goodwill. However there was proof the failure was due to the horrible driver and it shredded the clutch within 7k miles.

Did you see the clutch?

Are you 100% sure the failure was from the user and not a poor product?

Call Subaru of America, explain the situation and that you feel that the company has let you down after buying the car.

Get a case number, go back to dealership and get it fixed. Once the dealership knows you have a case #, they know you're serious about the situation. A local dealership didn't want to cover anything on my previous STI, after I told them I contacted SOA I got a shortblock and complete clutch assembly under warranty.

Just be nice to the dealership and mature about the situation (no screaming at the service people, etc)

Worked for me...

Sure did. I always look at the failed part when it comes to a questionable repair.

When we were removing the transmission, the first signs were clumps of sand under the vehicle in the brake drums, rear suspension components and on the Trans cross member. Then there were pieces of clutch material frayed into pieces all in the bell housing and around the shaft. That was not signs of a defective clutch, but the fact the vehicle might have gotten stuck. We still goodwilled it.
