Default Got Scammed? Get Even! Small Claims Court How-To

1. Find the small claims court in your county of New York and contact the clerk by phone and ask for the forms you need to file a claim. He/she will mail them to you, give you directions to the courthouse where you can fill them out in person, or direct you to a website where you can download them.

2. Calculate your total damages (turbo, shipping, anything related to this claim). Fill out the form which will require a simple explanation.

3. File your form with the clerk and bring supporting documentation with you at that time in case they ask for a simple explanation. You'll receive a court date then or by mail. You'll need to have Greysave served, ask the clerk how you can do that. You'll probably need to pay a fee there, or to Greysave's local police dept. to serve him. It'll be cheap and well worth it.

4. DAY IN COURT. Don't worry if it's a little confusing, it's also very informal. BRING ALL OF YOUR SUPPORTING DOCUMENTATION. Get your cancelled check, pics, print this forum, emails, dates of phone calls, everything. Tell the judge what happended and you'll probably get a default judgement since Greysave won't show up (if he shows up, great).

5. Enforcement. Ask the clerk or magistrate how to transfer the judgement to Georgia. I've done this several times and there's a simple form to transfer a judement from one state to another. Georgia's magistrate will forward the judgement to the magistrate in Greysave's area. Greysave will pay it or you work with the magistrate to hire a collections officer to take his money from him.

6. Be patient. It will take some time, probably a couple months. I've collected this way across states and received my $ every time.

Wouldnt this have to filed in Georgia(the location of the screwer not the screwee). Can anyone confirm this? In my case it was filed in a criminal court not a small claims court. Has anyone else been through this?
I contacted this agency. http://www.ic3.gov/
They got back with me after a complaint was filed, then put me in contact with local law enforcement and my case was resolved that way. I got all of my $800 back. It was a case almost identical to this.
