Default Please Help!!!! Member "greysave" screwed me over!!!

I need help!!! I purchased a turbo from greysave and it came destroyed! It was sent with out insurance and now he wont send my money back...I sent money via paypal but they only cover if it arrives or not, not in the condition its in....I SAID I WOULD SEND THE TURBO BACK TO HIM. PLEASE IF ANYONE FROM THIS FORUM SPEAKS TO GREYSAVE PLEASE TALK HIM INTO DOING THE RIGHT THING...WE ARE ALL ON HERE FOR THE SAME REASON, NOT TO SCREW OVER ANYONE!

Did you use a bank account via Paypal or credit card?

If credit card, you at least still have the option of attempting to dispute the charge on the basis of the damage.

BTW, Paypal blows...

Did you ask him to send it insured?
Did you offer to pay extra for shipping it with insurance?

Was it destroyed by the shipper or just a blow turbo? Also who made the turbo?

sorry for the confusion....no, my other member was for 3hrs 45 (under 4hrs no problems)...I paid through paypal via bank account but i could try i have citibank they're pretty good...I paid $30 for shipping (my fault i assumed that he would insure a 24hundred dollar turbo...ass out of u and me) It was shipped with 20 packing peanuts and it ripped through the box and must have hit the floor the whole compressor cover is shot and the compressor wheel scrapes the air inlet...its an aps sr55. if u need more info i check every minute im going nuts!

Yikes...paying via bank account with no mention of insurance. I'm sorry to say that this is probably not going to be favorable for you...sounds like completely unacceptable packaging too.

What did the seller say when you contacted him?

He said he wanted to send it to aps...but i spoke to them and it would be torn down tested re-balanced...alot of money and a looong time of no turbo for me...then he flipped it to being my fault because it happened in my post office and that he shipped it perfect and that i didnt ask for insurance...but C'MON! i gave him more than enough for shipping and its a $2k piece!!!!

He didn't happen to require a certain % over the price you agreed to to cover Paypal fees did he...I'm pretty sure in the past (not sure if its changed) that invalidated any seller protection from Paypal (as its a no-no, although people tend to do it all the time).

the price agrred upon was 800 for the turbo and 30 for shipping..i went through paypal, they sided with him because the item was shipped and recieved...nothing inbetween

Well if it was indeed bad packaging... thats pretty stupid on his part. If it was damaged and whatnot because of that... then you shouldnt be liable (IMO). Looks like you might have to go further with this?

My take: The shipping company is beholden only to the shipper, not the receiver, even if the item is insured. Therefore, up until the moment the item arrives at my house, whatever happens to it ultimately rests with the shipper. When they buy insurance, they do it to protect themselves. If the shipper did not insure the turbo, and on top of that did a crappy job of packing it... well, tough luck to him.

Dispute the charges.

First it was a 2400Hundred Dollar Turbo, then it was a $2000 Turbo, now it's an 800 turbo and 30 dollars for shipping. No wonder you're having problems, you don't know how much it's worth, how much it cost, and you lack the good sense to insure a package with the post office...I think you're forked.
