Greysave bent my @ss over a few months back. He sent me a set of 04sti heads of his car. They were thrown in a box not wrapped. I had to search around in the box to find all the pieces that had come apart, buckets bolts, avcs solenoid etc..The had also arrived dirty as hell covered in sand. It took two days in the tank soaking to clean them up. Wellwhen I final go to mount them the both exhaust cams won't set. I payed a guy to clean them, take out the old valves and put in supertechs measure lash. Come to find out that the heads have been over heated so bad that they where warped. the middle exhaust journal on both heads was 20th higher then the ends. He swore that he never raced or over heated. I payed around 600 for them and it cost me 500 to fix them, plus the labor for the tech twice over. Never got a penny and he denied he ever over heated them. so I can feelyour pain. There are a few @ss holes on the forums. He is one of them.

Wow, Greysaves is a fwck. If those pictures, and ^^^^ testimony are not enough for you to stop pointing fingers at everyone but yourself, may God be with you.

Wow, This is why I am a constant supporter of the feedback rating and strict enforcement of FS threads for new guys. This just blindsided you and I hope things work out for the best, i`m pretty sure he will realize that giving you your money back would be the SMARTEST thing to do.
Oh and BTW, 89 posts and majority are in the FS threads = bad news.

USPS doesnt just label packages damaged and unsealed just for the hell of it. they clearly recieved it that way. someone didnt open your package at the post office and mess it up then do a crappy job of resealing it just because they were having a bad day at work. you did a ****ty job of sealing it and you clearly were careless in protecting its contents therefore you are liable for it unless you can prove otherwise.

1. Find the small claims court in your county of New York and contact the clerk by phone and ask for the forms you need to file a claim. He/she will mail them to you, give you directions to the courthouse where you can fill them out in person, or direct you to a website where you can download them.

2. Calculate your total damages (turbo, shipping, anything related to this claim). Fill out the form which will require a simple explanation.

3. File your form with the clerk and bring supporting documentation with you at that time in case they ask for a simple explanation. You'll receive a court date then or by mail. You'll need to have Greysave served, ask the clerk how you can do that. You'll probably need to pay a fee there, or to Greysave's local police dept. to serve him. It'll be cheap and well worth it.

4. DAY IN COURT. Don't worry if it's a little confusing, it's also very informal. BRING ALL OF YOUR SUPPORTING DOCUMENTATION. Get your cancelled check, pics, print this forum, emails, dates of phone calls, everything. Tell the judge what happended and you'll probably get a default judgement since Greysave won't show up (if he shows up, great).

5. Enforcement. Ask the clerk or magistrate how to transfer the judgement to Georgia. I've done this several times and there's a simple form to transfer a judement from one state to another. Georgia's magistrate will forward the judgement to the magistrate in Greysave's area. Greysave will pay it or you work with the magistrate to hire a collections officer to take his money from him.

6. Be patient. It will take some time, probably a couple months. I've collected this way across states and received my $ every time.

This should be a stickie for folks that encounter this problem in the future. You should need to apply it to your state of course.

Well this doesnt surprise me. Greysave it sounds like your problems are mounting. It seems to me like Texy32 and Maverick need to contact one another and get something done about this. I wouldnt bother with small claims court. You should go straight to Graysaves local authorities. I have been in this situation before and charges were brought against the seller and things were resolved in a very short period of time. No matter what court you contact I believe it has to be in his jurisdiction not yours.
I would definitely try this link it is federal agency that was put together for this kind of fraud. He shipped this via USPS there are specific laws that cover this. http://www.ic3.gov/ They will take your complaint and put you in contact with the proper authorities. They got every penny I was out back to me.

This thread definately sparked my interest. i believe i have read all of these posts and skimmed a few therefore i would like to make a few comments:

The first thing that came to my mind was that greysave was stoned and thought he was shipping a large dead snail!!!

Anyways it appears that other sellers have experienced awful packaging from seller greysave. A true business man would ensure that all necessary precautions were taken to ensure a good transaction.

Maverick, i would have spoken with my bank first!! Personally, I have a credit union and they are the shhhh! I would have had them send back the charge and problem would be solved!! (unless there is something funky with paypal that i dont know about) Either way i worked at one for four years and still bank with them now and would have had it fixed.

I guess all I am trying to say is that its better to have personable relationships with the people who hold your $$!! Rep BCU++

When one reaches out across state lines to conduct business, as can be true of Internet commerce, the buyer can bring suit in their state. The question comes down to whether or not Greysave meets the Minimum Contacts requirement. Just depends on interpretation/jurisdiction but given that he's sold lots of stuff, and he's sold things in a part of the forum intended for commerce, then these facts may satisfy the requirements of the Minimum Contacts test. Bottom line small claims is cheap and easy and, if you follow through, you can get paid.

First off lets tell the whole story, around 6 months after you purchased the heads you tell me that they are warped and that I ever over heated the hell out of the heads or I must have used NOS. I told you that neither of the 2 happened. Furthermore you told me that they were warped and would cost 700 to repair, I asked my engine builder who Axis and was told me that it shouldn't cost more then 100 bucks to have the heads milled. You telling me it cost 500 bucks to mill heads seems a little bit over priced since I get my heads milled for 50 bucks or so 6 months after the fact. I then asked you if you wanted to send to Axis, but you told me that you had already taken care of it, and that you lost your "best friend" whatever that ment over the heads. The heads did not come to you clean but were not brand new, and why didn't you speak up when I asked again about the heads. I'm not going to on your word send you 700 bucks now you suddenly paid 500 though for some warped heads that only needed to be shaved. What company do you know that offers a 6 return policy on something, how would I know if they were even my original heads. Secondly to pay 600 dollars more for a routine service seemed a bit crazy to me, and I tried to have you call Axis several times even before I shipped the stuff out, so that he would take care of you, you did not, and telling me it costs 700 to fix warped heads seemed very outrageous not to mention you were sure that I used nos, which I have never had the plearsure of playing with, and you said the car must have been overheated which it wasn't. All heads need to be shaved before install.

What is so clear about them receiving the package like that? Why would the post office even except it like that, it was clearly crushed and i know usps would take a package with a giant gapping hole in the top of it. If you are trying to say I need to send Maverick his money back because the package was sent like that I am sorry but you are mistaken, furthermore yes there was little popcorn in the picture he posted, but with a giant hole like that chances are more then likely that the popcorn fell out since the hole is much larger then the popcorn. If you inspect the pictures the popcorn is smashed and crushed into the tape, which clearly shows the shipper damaging the package, so what everyone on this forum has come to the consensus of is that I am liable for usps. Those pictures do not reflect the condition of the package before it got shipped and to say that they didn't just slap the sticker on the package for nothing says nothing. How the hell do I know when it became unsealed but I did use excessive amounts of tape on the package.

Dude, the point is that you don't have a leg to stand on - if you thought the package could possibly be a liability in the future, you should have FIRST contacted the buyer about insurance and SECOND at least taken pictures of the box before it left your hands. That is the only thing that will even begin to save you right now seeing your past reputation (or lack thereof).

So your saying im liable because? What company have you ever heard of taking a picture of every package before it leaves your possesion? As the seller how am I responisible for insuring something the seller has paid for, as the buyer he should have asked for insurance, why assume that I am going to insure it?
