Insurance is for the shipper, not the buyer. Just because most private sellers choose to add that cost onto the buyer's price does not make it the buyer's responsibility. If you order a part from COBB and get it all trashed, you don't expect to be screwed over because they didn't insure it and you didn't specifically ask for it. That's because vendors figure that cost into the shipping before giving you the final price. greysave did not deliver the product he advertised - he's totally ripping Maverick off here.

ok just talked to my mom..she is a postmaster for usps...i skimmed thru yalls posts..and if neither of you all insured the turbo... then you cannot file a claim. nobody has power here. maverick ur screwed because of greysaves scam. sorry mane.

Every common carrier has insurance.. If you insure a product for the declared Value on the Bill of lading, then you will get insurance on the item. If you understate the declared value you, will still get less money from UPS. The company I work for offers $2.00/lbs. This is really nothing but companies like UPS might offer more.

You have a right to claim..I am 100% positive..

I continue to be amazed by the attitudes of some people...come on man, one way or the other, your buyer received a broken turbo and YOU'RE on the offensive. Give me a break.

i was under the impression they didnt insure the turbo.my bad.

Here is an angle I don't think anyone has considered. Perhaps Maverick is exaggerating the lack of care in packing the turbo and perhaps greysave actually packed it sufficiently and sent it out unharmed. They both have recourse in this case. Shipping an item to someone requires decent packing yes ill give you that, but, one can not reasonably expect that just because they didnt pay extra to ship it that the shipping company can be careless with it. Insurance itself is bullsh*t when it comes to shipping items because it can be difficult to get your money back and because the shipping company is pretty much saying "if you want us to care about your item then you'll pay us more than the cost to ship it".

What sort of policy is it that says "we dont care about your product unless you pay extra then i guess we HAVE to care". Maverick should NOT have started a thread bashing greysave unless he is 100% certain that greysave acted negligent in this case. Not only that but sure Maverick can sue and perhaps get his money back if he takes greysave to court. greysave would be completely justified in suing for libel if he can prove that the turbo was sufficiently packaged if this harms his reputation on IWSTI and affects sales of future products which is quite an easy win for greysave.

Maverick - could you provide us with pictures showing exactly the lack of packaging that you claim?

What nobody is taking into consideration either is how exactly shipping companies handle packages. Packaging something for shipping to another persons house is one thing. But preparing it to be thrown like a football and smacking onto the ground, being thrown around the facility sorting mail items, etc. is another. The problem here is that shipping companies do not care what you're shipping they'll treat it like its not worth a single penny.

My advice in this case, greysave keeps the money for the turbo, you or greysave file a claim for the cost of repair or replacement of the turbo(within reasonable amount of money), and you two dont do business with each other and delete this thread. Clearly greysave is NOT a scammer if he did in fact send out the turbo undamaged and in the condition advertised. But like i said until anything is definitely proven then i'd suggest deleting the thread and handling it privately.

If that solution doesnt work then split the cost of repairing the turbo and eat the losses from both sides. I'd be more inclined to side with greysave in this case(provided hes not full of it)because he lowered the price so much on the turbo. If the original price was 800+350 thats 1150, and Maverick's original offer was 650(talk about one hell of a lowball) then greysave would be justified in paying the smaller portion of the repair bill for the turbo if it needs to come to that. Sure i'll catch flak for this but so far nobody else has provided a reasonable and realistic solution for these 2 gentlemen.

Couple mistakes...

-First being the fact that you work in management, lol.
-Second saying that greysave is completely liable and Maverick has a 100% chance of winning considering the fact that all you know about it is what you've read on a forum, i wouldnt make that judgement just yet.
-Your packaging may in fact be OVERpackaging. I don't know how you work your shipping prices(i charge customers exactly what the shipper charges me so that they dont feel ripped off). If you do the same then you are overcharging your customers because of the added weight of the packaging you provide.

Sure nobody wants to recieve something broken in the mail but there is a certain point at which you go "dude you didnt have to package it like it was going to be dropped out of the bomb bay doors of a B-2." It is quite frustrating to have to tear off packaging material only to find even MORE packaging material. But im sure you use your good judgement on that since you work management in logistics. I wasn't aware that managers in logistics had law degrees as well and were certified/justified in telling people who would win in what case. I think we all are quite familiar with the law considering what we drive and i would wager that this case could go either way depending on who could prove what and keep calm while doing it.

I have several pictures of the box, the 24 peanuts and the 2 pieces of tape that the turbo was shipped in...if anyone would like to see them I will e-mail or i could set up a gallery on iwsti (I havent done that yet might need help..)

That is 100% troll. Give me a break...the lowering the price of the turbo has ABSOLUTELY nothing to do with the damage. (Read that sentence a few more times until it sinks in) It is ridiculous to suggest any remedy based on the price paid; he still purchased a turbo in the listed condition, not a damaged one. I like how you come out with an attitude against the buyer (perjoratively mentioning the "lowball" offer);

I like the "clearly...if..." statement you included in your first post too...no inherent contradiction in those two words. Actually, I would be willing to bet you do know the condition the turbo was in when mailed...

If you think that greysave could file (and win) a libel suit against Maverick, I'd seriously reconsider passing out legal ruminations online (and if that's a career choice, well...).

arkleseizure - you completely missed the point. everyone is blaming greysave for this without even a shred of evidence that he actually did anything wrong. so since nobody was taking his side i decided to give him the benefit of the doubt and maybe maverick was exaggerating the lack of packing. Not only that but sure greysave advertised a good turbo and sure he sent out a good turbo, once it leaves his house you cant reasonably expect that hes liable for whatever happens in transit. the only exception to this is if he himself is the one shipping it and drives it to maverick's house. i dont blame greysave at all nor do i blame maverick for the shipping. hopefully greysave isnt the type to be insulted by a lowball offer and decide that maverick will "get what he paid for" by sending him a broken turbo. that is a possibility though, its also possible that greysave packaged the turbo properly and that it was damaged in transit. these things happen. i can tell you for sure i wouldnt offer to cover the cost of insurance on an item if the buyer hit me up with an offer nearly 1/2 of what i was asking. i actually give props to greysave on this one for even accepting the offer. maverick would have heard my sharp tongue for offering me 650 dollars for a turbo that i was asking 1200 dollars for.


arkleseizure - apparently you're not quite as familiar with the law as you may think. nowadays it is not entirely difficult to win small judgement libel cases. its about as easy to win that case as it would be for maverick to win a judgement against greysave for the damaged turbo(also a fairly easy case). "clearly greysave isnt a scammer blah blah blah if he didnt send out a damaged turbo, etc." isnt a contradiction. here ill explain it for you: if greysave did in fact knowingly send out a damaged turbo in exchange for monies regarding a thread advertising a good condition turbo then yes he would be a scammer. if he sent out a good turbo and USPS dropped the box and broke it then thats not his fault. thats USPSs fault so that makes him NOT a scammer. i hope that clears it up for you.
