First off the buyer never asked for insurance nor did I imply I was going to insure it. I already took 350 dollars off of my original asking price to accomodate the buyer. The turbo was bubble rapped and in pop corn, if usps effed it up im sorry. I offered to fix the turbo, but was giving a choice, he chose to get smart with me, so I am doing neither now. Of course usps is going to blame me and I am going to blame them, but it shore looks like they dropped it pretty hard to me. If you wanted insurance you should have asked then you would have received. I for sure wasn't going to pay for insurance on a turbo that I took over 300 bucks off of. There is a difference in a bad clutch and damaged in shipping, to put the blame soley on me is ludricros, I didn't drop it, and thats what we are talking about, the turbo wasn't just damaged it was dropped. I guess he shouldn't have gotten smart with me before he got his issue resolved, I would have been inclined to refund it, then to apologize after paypal closes your case, is not going to get you anything either. Paypal closed it for a reason, because they and I are not responsible for damaged in shipping.

No you are not responsible for damage in shipping. But you are the only one who can claim -- and recover -- damages. Recipient has no power to do so.

Thank you for replying to this member's alleged dispute with regard to your transaction. Can you explain how this member 'got smart' with you such that you would not be willing to take an action you now suggest you would have been willing to take had he acted differently in the matter? I am curious as to how his action would force you to close off this option other than for personal reasons.

EXACTLY i have all e-mails sent and I bought this turbo as a favor...I didnt need it but he said he had to get rid of it...I offered him 650 he said 800 and 30 for shipping....

Greysave, I work in management in the logistics industry. I hate to break it to you, but you are 100% liable and if Maverick takes you to court he will win. You are the shipper and he is the consignee. If he had elected to have the freight sent collect he would be liable. However you shipped the item PPD and you are 100% liable. It is up to you to dispute it with UPS. All common carriers have an added insurance that goes by weight. UPS will have a payout for you; you just have to file a claim. Maverick cannot file this claim. This is why when you sent an item to someone; please package properly. Ask anyone I have shipped a part too; it takes them 15 minutes to get it unpackaged. But it will arrive undamaged. I have had many members on this site PM me and say whats with this crazy packaging. I say "don't complain, it arrived undamaged".

To be honest I could have kept it for another project and was considering doing so. Anyway you look at it 300 bucks is alot for waiting less then a month. You don't have buy anything from me, but I was sure selling everything for more then resonable prices though.

You're responsible until the buyer receives it in the condition it was described to be in. You are the shipping agent, the liability is on you to file a claim with USPS.

greysave, I am not taking sides or casting judgement on you. I am sure you are a nice guy. But I am just telling you from a legal stand point what your position is. UPS will either provide you some sort of value or perhaps pay for the cost of the repair.

It is worth looking into instead of going through a legal battle which will cost both of you time and money..

Maverick, sorry you're having to go thru this but according to the USPS Claim form instructions http://www.usps.com/forms/_pdf/ps1000.pdf under section 3..."NOTE: Do not return the damaged parcel(s) to the mailer to file the claim. Either the addressee or the mailer may file claims for
damage or loss of contents.".
Also under section 3 of the form, either the adressee OR the mailer can be selected to recieve the check

The problem with Maverick filing the claim without all the supporting documents; the claim will be denied.

I agree, but I imagine it would be easier to get Greysave to mail the original mailing receipt to Maverick than to get him to file a claim.

Of course, maybe Greysave didn't research the process to file a claim with the USPS. Now he can see how easy it is and hopefully he'll be a bit more helpful in resolving this problem.
