I wouldn't have argued with the officer; that's what court is for. Additionally I would've signed the ticket and been on my way. Also I probably wouldn't have been pulled over to begin with because I rarely go above 75 which is really only about 70mph since our (at least my) speedo is off. The cop went into the situation with an attitude which was unprofessional, he exceeded his authority (he could simply have dropped the ticket in the guy's lap, told him to read it, and had an arrest warrant issued when the guy didn't show up in court. Cop didn't need to do his power trip routine which led directly to Tazing the guy in the road, traumatizing the drivers pregnant wife and the child riding in his car seat. Said cop then lied about the circumstances when the county mountie showed up, and his terminology in describing ("guy took a ride on the Tazer")the events certainly gives Utah law enforcement a public relations black eye. This guy would be better suited to being a guard at the state prison. Many of my fellow Utahns feel the same, from the conversations I've had with them about this sorry situation. | |

IWSTI Addict since: Dec 2003 Trader Rating: (1) | i have to disgree with most of you guys. obviously the cop could have done a better job of talking to the driver and explaining the procedure. however, at the exact moment he tazed him, the cop was giving him very clear instructions with his tazer already drawn. not only did the driver fail to comply with his directive but he also turned and started walking away with his right hand in his pocket. technically, the cop was well within the proper procedures for using his tazer. i bet that's the last time he fails to comply. some lessons are learnt the hard way. |

So where is that info coming from? I also reviewed the video a couple of more times. While I still maintain that the Officer did nothing technically wrong as far as his use of force, I did notice a few things that struck me as stupid on the part of the cop. As for the a$$hat that was pulled over, I think we all know what he did wrong. As for the cop.... (1)When he approached the vehicle he had an attitude. This caused him to lose control of the traffic stop from the very beginning. (2)He argued with the driver about the ticket. NEVER argue with the subject. This caused a further deterioration of his control of the situation. (3)He never explained the consequences of not signing the ticket. After pulling the driver out of the vehicle, the Officer should have explained to the driver the consequences of not signing. After the driver refuses again, THEN tell him to turn around and place his hands behind his back and inform him that he is under arrest. This is NOT a requirement, it is just a good idea. It COULD have possibly de-escalated the incident to the point that the Tazer would not have been needed. (4)He draws his Tazer too quickly. IMO the officer did not give adequate direction to the driver as to what he wanted him to do and why before drawing his Tazer. He also, prior to drawing the Tazer and tazing him, never told the driver that he was under arrest. However, AFTER drawing the Tazer, the officer was VERY CLEAR with his directives. The Driver should have complied instead of attempting to walk away while reaching into his pocket. While the Officer was technically correct in his use of force, he does need to receive some refresher training on how to conduct a proper traffic stop. Also, the officer does not need to read the driver his Miranda Rights. The driver was not being questioned. Just placing him under arrest does not mean that he has to have his Miranda Rights read to him. That is Television. Last edited by Crash1973; 11-26-2007 at 03:50 PM.
