It may depend on the state, but I believe you were not at fault being rear ended. Take it to a shop in which you wish to have it repaired and send the estimate to the insurance company.

Whatever you do.....DON'T call your Insurance company. Talk to your agent only, and tell them not to report the accident, or you can kiss your premiums goodbye!!! They will group you into a risk category even if YOU were NOT at fault. As far as getting your parts on, you would have to work something out with the body shop you go to. If you can find a body shop that is willing to work with you on giving the other person's insurance company a quote for the damage repair, and then have him paint and install something for you that will make him the same money or more.......than I would be willing to bet that you could get someone to do it for you.

I can't reiterate enough.....NOT to talk to your claims department for your own insurance. You'll regret it for the next 3-5 years with your premiums.

Good luck.

That is not true. They can not raise your rates if you had no fault. In most states, being hit from behind is always faulted to the car in back. You can review the police report.

3 years ago, an uninsured worthless penniless drunken bastard sideswiped my car AND my wifes car in one swoop. 2 years ago, our neighbor's tree fell on BOTH of our cars. I swear I am not making this up. Her Homeowners refused to pay for our cars even after our auto insurance took them to arbitration. On both occasions, Allstate paid for repairs to both of our cars, provided TWO rental cars for us, assigned us 0% liability and our rates did not change. I currently insure my '05 STi and my wifes '04 Toyota Sienna for $145 per month. Based on what I have read in other threads here, that is a better rate than most are getting.

You paid for the insurance . . . use it.

I guess my post was partial missleading as it will not directly effect your premium because a no fault (if your state has no fault) is not a chargeable offense. What it will do by calling it in will eliminate any discounts you have related to having no claims or being a responsible driver. This in turn will raise your premiums if you currently receive discounts. You will be grouped into a tier that will be of higher risk = higher premiums eventually if you ever do have a claim. You might be asking how I know this? or maybe not...but I'm going to tell you anyways.
1) my wife works for Allstate, my brother's an insurance agent, and a lot of my extended family is in the insurance business and we always have debates on how screwed up the insurance world really is.
2) I parked my 04 silverado in the mall parking lot about 3 months ago to watch a movie with my wife and some friends. When we came out my wife pointed out that someone had hit my right rear passenger door and dented it in. (they had to have been backing out of the parking space the wrong way and rolled their front bumper across my rear door ) I regretfully called the claims (of course it's Allstate) number to ask if I could consider it a comprehensive claim since no one was driving and no one left a note. Unfortunately she logged up our conversation as me reporting a claim or having a possible claim. To add insult to injury, in my state (Idaho) we do not have no fault claims here. So they show this call in as a possible/attempted claim and I have lost my Strategic Risk Management Discount as well as my preferred policy on my next renewal date which was 1.5 months ago. The end result was my premiums increasing $213 every six months. I was only paying $417 every six months for the 2 trucks I own. Now it is $630. A 50% INCREASE

I've done absoultely everything I can possibly do, but they will not give me the discounts back. So I might just have to switch companies to dispute it and get my discounts back.

Long story short. Never call your claims department until after you talk to your agent. If your agent tells you to call, then call.

I honestly wish we could without it effecting us down the road!!!

Good news for all you Allstate customers. Call your agents at the end of the month and ask to be switched to their new Auto insurance company they are creating. You can get benefits of accident waiver, ticket waiver, deductible waiver. All nice things when you own a sports car!!!

Finally.......I'm done talking. Hopefully one person has gotten 1 useful piece of info out of this?
