like someone else said, search your binder and look for anything stating coverages, then look at their site and see what is covered based on those terms. you have rights.

It was recommended to me to list the parts that were stolen, to really shed some perspective on my claim....

pretty much, everything was bolted down except the 100cd case, even the Valentine One was hard mounted and hardwired.

Basically, they only took things that were easy to remove:

Carbon fiber NOS bottle
1000cc injectors, fuel rail, fuel lines, aeromotive regulator
Vafc
P72 ecu with Hondata s300
Various guages
Blitz sbc-id and power-meter id
Valentine One

They got one bolt off the exhuast manifold, as I think they started trying to get the turbo and manifold.

I can understand them not covering the NOS bottle, as there is no other purpose and it could be construed to be a "race part", but everything else is pretty standard...

There was of course damage to the car too: cut wiring (for the alarm and Lojack brains that they stole), locks, ignition, steering column, and around the keyhole on the passenger side door.

They fortunately didn't get any of the really expensive turbo/engine/stereo stuff....

Yes, it is/was an acura, but it was my very first modded car- and modded with only the best!

So I requestesd all my signed policy docs from Allstate. I didn't remember signing anything stating that my parts weren't covered.

They sent me the most recent policy, without my signature, no policy number, and no efffective date that included page 18 and line (14)- that mentions exclusion of race parts.

I have my original policy and all the addendums that I recieved in the mail from when I first signed up- there are no exclusions saying anything about race parts anywhere in the policy- i've read it forwards and backwards. There is nothing!

So, can insuance companies change your coverage without you signing anything or notifying you of those changes?

They also sent me a copy of every signed policy change that I made. Including the one where I added the additional coverage and it shows, that the appraised value of my car is $30,000- that was effective 4:44pm 1/26/2005

They also sent me a copy of my orignal application for insurance with Allstate where my Acura integra is listed as a 1995 Acura integra vtec turbo, that was 4/28/2003..... Hmmmmm...... I knew I told my agent everything.....

I sent a letter thanking them for the info, and asking a couple questions.

We'll see!

So I heard back from the State Insurance commisioners office...

Here's their letter:

"Enclosed is a copy of the response from Allstate property and Casualty Insurance Company to your request for consumer assistance regarding the denial of your claim for damages to your vehicle.

The company has concluded their investigation by talking with your original agent. There seems to be a dispute over waht was discussed between you and the agent. The company is standing on the denail of your claim. if you wish to pursue this matter, you will need to seek legal advice.

Thank you for bringing your concern to the Office of the Insurance Commisioner. We hope our explanation of the situation is clear to you. We regret that we have been unable to help you obtain the results you sought. In situations like yours, the limits on our jurisdiction and powers are sometimes frustrating, Please feel free to contact us if you have questions or further information from us.

Sincerely,

April A Findley"

So I guess Allstate is more powerful than our government.....

Does any one know a good lawyer?

How do I get Allstate to cover the other damages??? Will they replace the stolen parts with stock parts?

I'm so Pissed!

Im already having problems with them as well..... VERY slow time to send an adjuster to go see my car.... Im giving them by the end of tommorow and im calling up and having my way with them. I work in insurance and this is not the way claims are supposed to be done.

I wouldn't wait, all you do by waiting is give them more of an advantage...

I think Allstate needs to have as many complaints filed against them as possible for everything they do. If you don't get resolution from them when you call, bypass them and call your state insurance commissioner's office.

I'm no expert, but they need to change their way of doing business or get out of it.

Kir,

If you file an insurance complaint and list everything they are doing wrong. Took too long etc. It can actually be a chargeable offense and cost them a fine.

I know in NY you can file the complaint online. Check for your state in google typing in "NY insurance department" click around on some links to find the appropriate page to file a complaint. Do what it takes to get them off of their arse and get something done.

When they are finished paying for your claim. Cancel your policy and switch to someone else.

Sorry to hear about your continued problem. The insurance department really cant make Allstate pay because they technically do not have to due to their policy language. If you are correct that someone told you that it should be covered, I can see where you are coming from. But if it was never in writing, there is pretty much nothing you can do.

Just wait, it only gets worse when dealing with Allstate! Just remember, "You are not in good hands with Allstate" They will deny everything that you propose and will take the case all the way to court but then at the last minute make a settlement offer. I know this because I am going through this right now with them. From what I heard the lawyers for Allstate try to bill as much time as they can so they too can make a profit, no wonder why our rates are so damn high. Good luck and keep up the good fight becuase they are trying to make it so hard for yourself that you wont. My claim is getting close to the two year mark now.

Sorry to hear about your plight man. I had my own issues with Erie Insurance a while back. Insurance companies are borderline criminal sometimes. I've always had such a love-hate relationship with them.

Thanks bro i am aware that i can file a claim with the NY state insurance dept... im waiting to see what happens with this claim.... The claim girl says shes going to contact me back...

Allstate takes like a week or so to go see ur car!

When I was young, my parents had Allstate Ins. My mom was stopped at a red stop light and a guy rear-ended her and the police said he was traveling at a rate of 40 - 45 mph. It pushed the back end of her mercedes in about 1 1/2 feet.

Making a long story short...the guy who hit her had Allstate Ins. as well. Allstate came back at some point and was wavering on providing proper coverage. They tried denying a few parts of the claim, tried to make my mom part at fault (for what reason I still do not understand). Allstate caused my parents a lot of extra stress when my mom was already dealing with medical problems from being hit so hard.

I WILL NEVER USE ALLSTATE FOR ANYTHING IN MY LIFE AND WILL ALWAYS RECOMMEND PEOPLE NOT USE ALLSTATE.

Yes, this was a long time ago...but, the repercussions from asinine business dealings are a biotch.

Sounds to me like your buddy Steve screwed you over just to sell a policy. If you didn't submit copies of every invoice you have, parts-wise, there's no way for them to know exactly what you're insuring.

Last year, I had Nationwide for my home and car, and I called wanting to get additional coverage for all my mods. So, I take all my invoices for her to copy and submit to Nationwide, and she calls me back and says they are dropping me altogether, because I have a modified engine ! So I go to another company, just get a basic policy, and shut my mouth.

I also checked with Hagerty insurance, since my 06 STi only has 12,000 miles on her now. They wouldn't cover me because I don't have another vehicle for a daily driver ! So, if I buy a beater car ( and buy license and insurance ), then Hagerty will give me 60,000. coverage for 1200.00 a year.

I can't win for losing !

Allstate is a very selfish company. The state of Missouri has been charging them $28,000 a day for months and months now because they refuse to hand over documents that have been subpoenaed by the state for a court case against Allstate. The same thing happened in Florida and the insurance commisoner actually revoked their liscense to do business in that state. Needless to say the documents asked for were produced quickly although they had been HEAVILY blacked out in areas. Allstate is a bunch of crooks. I have never used them and NEVER will!!!!!

JD Powers and Associates is always a good place to find ranking of all sorts of companies.

For the insurance industry, there are two companies that are so far ahead of the rest in customer satisfaction, and the other aspects of JD Powers ranking system, that I believe the other companies are worthless.

The number one, best ranked, and reviewed company is USAA. They are a non-profit insuarance company only available to veterans and immediate family of those veterans. But it is only available to family members as long as the veteran has USAA.

That option is out for me.

Amica is the only company that scores highly- available nationwide. There are smaller companies that are small town local only insurance companies that come close, but USAA and Amica are ranked the highest! Both earning perfect scores!

I don't care about cost, I'm going with Amica after this claim is done. Good reliable service when you need it, is worth more than saving a couple bucks a month.
