Default Finally!!!!!!!!

To those who dont know about my wreck, I was broadsided by a guy who ran a red light and did $23,600 in damage to my car and Allstate fixed the car......Well I got a call today from my attorney's secretary who told me that allstate is willing to settle to 11,700 in bodily injury and 11,500 in diminished value from them repairing my car. There is no case law regarding diminished value and a Subaru GM told me that diminished value is generally 50% of the repair costs....Allstate is finally in range of what I want so I think that I am going to take their 23,200 and run with it.......

So you got your car fixed by insurance, nothing out of pocket and get a fat check for $23k.... If that is the case I would take it and run as well.

11,700 for body injury? Were u actually injured in the accident?
11.5k for dim. value? Meaning that your car is fixed now but there gonna pay you because you have a rebuild title?

Did you didnt take the route for cheaper insurance and get LIMITED TORT? Technically if you did then you cant sue unless you received severe bodily harm from the accident.

So far I dont have anyother options other than to keep the case open and fight for more money but since Louisiana doesn't have any case law on diminished value then its going to get harder the more that I push. At the same time I dont want to push to hard and have it come back to bite me on the @$$. So there is the possibility of it going to court and the judge can rule against the diminished value because the car was repaired.

Thankfully I didnt get hurt other than a badly bruised shoulder from where I was hit by the b-pillar. I fully believe that the safety of Subaru saved my life as well as my kids lives as well. I just wished that they would have totaled the car as they legally should have because I dont want to run the risk of having that car to save my life again in the event of a similiar impact.

Inspite of it all my title is still clean but its reported as severe damage on Carfax but it still sucks though as I wont be able to trade it in on another vehicle someone is willing to buy the car despite the damage done. I am torn as to whether to sell the car and get another or pay it completely off and let the real modding begin with the left over money after the 1/3 attorney's fees

If you're going to daily drive the car, I'd probably sell it and use the settlement to offset the diminished value - which is what it's for. As good a job as that shop did, there's precisely ZERO way the car should have been repaired.

I would also worry that, even though it was repaired, the metal fatigue and the forces that the car absorbed in that impact probably weakened the structure to some degree. Now, if you were going to balls-out cage it, that's not as much a problem since you'd be putting in a brand new safety system with the car as a shell.

So, daily driver = sell it. Hardcore racer = keep it.

Was Allstate being a hard ass about this at first and that is why you called a lawyer?

Did they actually pay $23,600 to repair your car?

If so, the $23,600+$11,500=$35,100. They basically ended up paying more than they would have paid to total the car and keep it off the road. Who wants to drive a car with that much damage?

I wonder what the car would sell for with full disclosure to the buyer? Sure you can sucker someone if they don't get a Carfax report, but personally I wouldn't want to given all of the damage.

KBB is around $23,000 for fair condition. I guessif you can sell it for $15,000 you will come out OK after lawyer fees. Take the deal and get a new insurance company.

If I were you, I would pay it completely off, then trade it in immediately for a new car. Dealers are hurting right now and they'd rather take your trade and turn a new unit than see business go out the door. They'll just wholesale your car and never look back.

$11.5k in diminished value is awesome. Blue Book is probably around 20k...I'm sure you could sell it to some high school kid for 15k who thinks he is getting a deal and you are happy, win-win. You just made ~$6.5k! I recommend you sell it though for sure.
