lets see if they will take the offer request.....After all they clearly dropped the ball from the get go with the first appraisal of the car when they decided to fix a car that had over 75% damage

Yea I still can't believe that. I would have been ALL OVER them about that. 22k worth of damage...lol what a joke.

40k inclusive of meds and a BI claim? BI and PD are typically handled separately. Maybe you can clarify for us.

Dont forget your attorney will take a chunk of whatever your settlement is.

18 for BI which includes payment off all the medical bills and then the 22 for the diminished value

What injuries did you have and treatment and I can give you a pretty good idea of what your claim is worth. PM me if you dont want to discuss it on here.

BI is much easier for me to estimate since I dont handle PD that much.

I just found the statue on the Louisiana law on totaled vehicles. The 3rd party appraiser hired by Allstate velued my car at 30,000.xx at the time of the crash and 75% of that is 22,500.xx and the repairs on the car were 22,600.xx

Here it is: L.A.R.S 32:702

(11) The term "salvage title" shall mean a certificate used to evidence the declaration in an insurance settlement that a motor vehicle is a "total loss" motor vehicle as provided in this Chapter, to be prescribed and distributed by the office of motor vehicles, to an insurance company, its authorized agent, or the owner of a "total loss" motor vehicle.

(12) The term "total loss" means a motor vehicle which has sustained damages equivalent to seventy-five percent or more of the market value as determined by the most current National Automobile Dealers Association Handbook.


So technically I have a repaired vehicle that had over 75% in damage according to this law, and I am paying interest and principal on a vehicle that i purchased with a clean title which should technically have a salvaged title. I have asked for all the interest paid on this loan since the day of the accident as that is the day that this should have been a total loss. Am I being unreasonable here?


My request:
1. Payoff of the vehicle as the car should have been a total loss as of August 06
2. Interest Paid on the loan since the date of the accident
3. Attorneys fees for the insurance company's violation of the state law as this should have been a total loss and not have been drug out for 2 years
4. Payment of medical bills
5. Pain and suffering.

Am I being unreasonable here?
