M... If it were me, standing there about to buy your car or at least make an offer on your car, KNOWING about all 22k worth of damage that was fixed, and assuming that it would of been worth lets say 25k had it never been in an accident... I would probably make you a serious offer of somewhere around 15k... on a good day.

Well I went by Performance Subaru in Chapel Hill and had my vehicle appraised!...........My car was appraised for 10,000! I knew it was coming! If I get the difference should I pay off the car and mod the bejesus out of it, pay it off and take the 10,000 and trade in on a 08 Aspen STI on golds, or pay it off and not touch it? I figure that its not worth anything really so why not let the modding begin

If it were me. I would trade it and go for the 08. I cant imagine paying all that money for a new car and have it damaged so badly. I would want a new car.

Holycrap! I'm sorry to hear that M. My GF is an insurance adjuster, and we discuss things like this ALL the time. Often the topic of "reduced value" after an accident comes up with people and their cars, and unfortunately, the only thing the insurance company is required to do, is repair the car back to its original condition... they are unfortunately NOT responsible for extra/preceived depreciation due to being in an accident. It comes up ALL the time at her job, and extra payout for depeciation NEVER happens... not ever.

Now, your bodyshop guy TOLD you straight up, who can hopefully be some kind of witness for you, that he was NOT able to restore the car to its original condition, claiming that its safety has now been perminently compromised on that side of the car. I think with that testimoney, Allstate is toast... Because if the car can't be made just as safe as it was before the accident, it HAS to be totaled.

What I would of asked the bodyshop guy from the start would of been, "if you can't get the car back to 100%, in regards to safety for example, assuming some kind of unrepairable frame issue, then please quote the cost of a NEW Frame from the ground up. I'm guessing then that the repair costs would of gone from 22k to 33k, and allstate would of thrown in the towel.

I wish you all the best proving that allstate mishandled your claim.

With the extent of damages done to my vehicle and the work done to it I dont believe that it will be very hard to prove that my vehicle did in fact lose value due to the accident. I was also contacted by Allstate on 02/06/08 in regards to wanting to settle a diminished value claim.

"In Defraites v. State Farm Mutual Automobile Insurance Co., 864 So.2d 254 (La.App. Cir.5 01/27/2004) the Court of Appeal held:

Louisiana law provides that diminution in value of a vehicle involved in an accident is an element of recoverable damages if sufficiently established. In a case involving damages to an automobile, where the measure of damages is the cost of repair, additional damages for depreciation may be recovered for the diminution of value due to the vehicle's involvement in an accident. However, there must be proof of such diminished value. Davies v. Automotive Cas, Ins., 26,112 (La. App. 2 Cir. 127/94), 647 So.2d 419. The jurisprudence awarding damages for depreciation involves facts wherein a repaired vehicle decreases in value, despite a quality repair job, solely due to the fact that the vehicle was involved in a collision."

For the other party that hit you, have you considered suing as they were in the wrong doing and you have to suffer the sharp depreciation in value of your car?

M, sorry to see your car in that state. With the safety of your family in mind and what you wifes' cousin is saying about potential impact results down the road, dump it when it's all fixed. Take the hit if you have to, but safety first.

Nice, insurance company 0, ///MPower 1.

if the car drives in a straight line and is near perfect, pay off and mod the hell out of it.

you only live once, and no car payment would be nice. (then again you would likely have to buy another vehicle?)

i say, just like the rally car, tac weld the weak spots, add braces, roll cages, etc. and build it up.
welder is like 500 bucks (i think). lol

either way, have some fun with it.

EDIT: and think, if you trade it in, the dealership will give like 10k and then sell it to someone who doesnt know for like 24k. that would bother me!!

Thats how the suit is filed. The suit is being brought against the at fault party and the at fault parties insurance company and the coverage policy. I hate being a d1ck about this but I have to be because its my money at stake. I have tried repeatedly to have this settled and I refuse to back down in this matter and have to take a monetary loss. I bought a brand new untarnished car in 2006, not a car that now is damaged goods.

I got a call from the appraiser that Allstate sent out to value my vehicle and he even said it should have been a total after he saw the damage done and what it took to repair it. Hopefully this will work itself out in the end.
