Default Advice on 5th gear syncro and my dealer?

So my '04 at 36k miles really started to develop the 6 --> 5th gear grind. I searched the threads on 5th gear grind, but have a couple questions. I'm already past my warranty, my dealer has already told me in my very few and unhappy visits with them.

However the drivetrain warranty is 5 years or 60k miles, correct?

I'm aware of the fact that the car was modded by the previous owner in the 18k miles before I got it, and the dealer I was seeing is aware of this too as the car was in for some work. But mods would not have anything to do with a 5th gear syncro issue, am I right?

Basically, I plan on going to the other dealer in town and saying heres the problem, its well documented as in threads such as the ones I've searched, and it should be covered under my 60k mile power train warranty. I do not think they will be aware of the previous mods like the other dealer, but if they do I don't think thats the cause of this problem.

I just don't want to put up $1500 like one of the posters said he had to only to have them say its my fault. Any help on how I should bring this in?

I had mine done at garcia with my full exhaust at about 25k. This repair should be covered under the 5 year 60k, and if it comes down to it bring out that act that states they have to prove the mods caused the problem. As a last result call SOA and complain, this is a common issue that they should know about.

Hey Aaron thanks for the reply,

I spoke to the Garcia guys today about an appointment in January, they said it shouldn't be a big deal. I'm tired of getting hassled by the Lee and Galles guys over stupid stuff but I think Garcia sounds better.

Off topic but my internet and computer got all screwed up last month and I don't think I heard back from you about the extended armrest. I hate it a little less after I did some work on it but if you're still interested we should see if we want to trade.

Also, are you planning on doing an '05 bearing swap in the future?

I called SOA and they gave me a case number. When I went to my local Subaru dealership they were like "Um oh well, ummm..." After I told them I called Subaru and got a case number and they told me it was under warranty, I had a synchro in 3 days.

Car was stock

it's really not about mods. they will be looking for abuse when they inspect the clutch and flywheel. if you are sure that you didn't do hard launches, i think youre reasonably safe agreeing to pay for the labor pending an inspection and decision in your favor.

^^^ So does everyone have to front the cash for the inspection, or is it more on a case by case basis? I am a little wary of putting up the money because, while I have obviously driven the car its only seen one 4.5k launch and a couple track days, I'm not sure what abuse the previous owner dished out. I haven't had any problems, the stock clutch is fine, etc, but I'm afraid if the dealer claims he abused then I'll be out of some $$$.

Spyder 2723, how did Galles do it for you?

I went in and said that 5th gear is grinding. They pulled it apart, saw a bit of abuse on my clutch but that didn't stop them. I did pay like $750 for a new OEM clutch to be installed at the same time because mine was just about gone. The service manager guy showed me the hotspots on my flywheel and they still did the repair under warranty.

Something I whish I had considered before going in was to have the JDM 5th and 6th gears in hand and have them install those at the same time to solve the problem for good. Unfortunatly I didn't and the other day I know I was shifting right and felt 5th give me some resistance so Imight have to go back in soon.

Off topic: I wouldn't mind check out the armrest but if you are comfortable with it now don't worry about it, it isn't high on my list of mods that need to get done.

The one that is high right now is the 05 bearing swap. My main thing right now is trying to figure out the best way to go about it with out having my car down for long. Hopefully I can have most of the parts sourced and in hand before febuary.

federal law states that if you have modified your vehicle and have any warranty issues the dealership has to prove that those modifications cause the failure. with that i have a full stock turbo build and i was having the same problems. instead of getting factory synchros for the 04 i got the 06 carbon coned synchros that i sourced from rallispec. the dealership wouldnt install unless i paid for them. they would pay their part number under warranty but not the ones i wanted. so purchased them and got them to install it under warranty. while your in there you might as well replace 4th 5th and 6th all those synchros from rallispec were like 60 bucks. but also you might want to replace 2nd. but its a double cone synchro and it costs much more. good luck and get to know the technician he'll help you out. he installed a clutch and flywheel for me for free(the trans was out already). in my opinion you dont need to get the jdm gears because they are so short but the gears do come with the carbon synchros which you can buy separately at rallispec. give them a call and they'll straighten you out.
