I have been trying to sell for a while. Now I am selling my house and moving. I have to thin things out. I am also selling my 1978 Nova on eBay.

The guy bailed on the car last night. The guy buying his car changed his mind...so now he is not buying mine.

Here is the question...He gave me a $1000 deposit. After he gave me the deposit I took off the Cobb TBE and AP and sold that. What should I do with the deposit?

The guy was pretty unhappy about it, but I just spent the past 3 days on the phone arranging shipping of the car to Canada, I have a car at the dealership waiting for me, and I took the exhaust off my car and sold it. I also had the car on ebay when he gave me the deposit. There was 30 watchers and about 10 had emailed me with questions. After I took it off, 3 emailed me and asked when I was putting it back on ebay.

I want to keep the deposit and sell the car again for about $1000 less than I was asking...but I am having a hard time feeling O.K. about keeping all of the deposit.

Any and all opinions appreciated.

I would maybe give the guy half of his deposit back, that seems fair. I think that would actually be more of a good gesture on your part since technically the whole deposit I believe is rightfully yours. But I think youd probably feel better splitting it, and giving him $500 back, and you keeping $500.

More good news.
It looks like I can not get the deposit back that I put on the car that I have at the dealership. I had it special ordered with Nav and they said that I can not get it back.

Was the purchasing contract $1000 non refundable? If so the $1000 is yours. The individual that was going to purchase the vehicle knew the terms of the contract so therefore I'm sure he thought about that before he decided to back out. I do agree it would feel akward keeping the money though but if you lowered the price of the vehicle $1000 like you thought about doing then maybe you won't feel so bad. The car looks great and good luck with the sale!!

I took the car off of ebay after he sent me the deposit. It stated on ebay that it was non-refundable. Since it was not technically sold on ebay...there was nothing in writing. The only reason I took it off ebay was because he needed an answer no later than the day before the ebay listing ended. He said that the guy buying his car gave him a deposit, but I dont know if he refunded it.

So if you put this money on a deposit for a new car, and now you cant get that car. And cant get that deposit back, then just tell the guy sorry, the money is gone. There really isnt anything he can do about it, it seems. That all just sucks all around I guess.

If you were going buy the e-bay terms and it said non-refunable then he is out his money. Are you buying an '08 sti? Your car will sell quickly i would think. Do you have the stock airbox and is the car stage 1 now or the ecu put back to stock?

I took the exhaust off and returned the ecu to stock. I am getting an automatic vehicle for a while so I can have knee surgery. I will get another STI or similar some time next year.

If I can get the same money for the car that he was paying (and do it soon so I can get the other car and not lose $$), then I will give him all but $100-150 back so I can cover all of what I did to prepare the car for shipping.

fyi.. if he paid through the deposit through paypal then its yours. paypal car deposits are non refundable.. ive been through it. i got to keep the money. i think thats why they only allow a $500 deposit now.
